Si resideix a Barcelona li podem recomanar un dels nostres notaris de confian\u00e7a i acompanyar-lo en tot els tr\u00e0mits previs a la venda.   <\/p>\n<h2><strong>Quins documents necessitar\u00e0 per acceptar l&#8217; her\u00e8ncia.<\/strong><\/h2>\n<h3><strong>Certificat de defunci\u00f3<\/strong><\/h3>\n<p>El certificat de defunci\u00f3 \u00e9s l&#8217; \u00fanic <strong>document oficial<\/strong><strong> que acredita la mort d&#8217;<\/strong> una persona. \u00c9s necessari per posar realitzar tr\u00e0mits molt diversos com gestionar la pensi\u00f3 de vidu\u00eftat, procedir a l&#8217;enterrament o a un trasllat de n\u00ednxol, cancel\u00b7lar un compte bancari o accedir a les prestacions de l&#8217;asseguran\u00e7a de vida de la persona morta o a la seva her\u00e8ncia. Aquest certificat l&#8217; expedeix el metge que acredita la mort i es registra en el registre civil on es registra el naixement de la persona morta. <\/p>\n<h3><strong>Certificat d&#8217; darreres voluntats<\/strong><\/h3>\n<p>El Certificat d&#8217; \u00daltimes Voluntats es pot demanar en qualsevol de les Ger\u00e8ncies Territorials del Ministeri de Just\u00edcia, en els Registres Civils de tot Espanya. El certificat d&#8217; darreres voluntats serveix per saber en quina data s&#8217; havia atorgat el darrer testament i en quina notaria i ho pot demanar qualsevol parent amb inter\u00e8s leg\u00edtim. <\/p>\n<h3><strong>Testament<\/strong><\/h3>\n<p>Si no disposa de l&#8217; original, podr\u00e0 demanar una c\u00f2pia a la notaria que consta en les darreres voluntats.<\/p>\n<h3><strong>Certificat de l&#8217; asseguran\u00e7a de vida<\/strong><\/h3>\n<p>\u00c9s el document que acredita les assegurances en qu\u00e8 figura la persona morta. Aquest document s&#8217;ha de sol\u00b7licitar al Ministeri de Just\u00edcia, que disposa d&#8217;una base de dades sobre les p\u00f2lisses de vida contractades a Espanya. El registre es va crear perqu\u00e8 gran nombre dels beneficiaris es quedaven sense cobrar per desconeixement de l&#8217;exist\u00e8ncia d&#8217;una p\u00f2lissa contractada. La notaria on s&#8217;hagi d&#8217;acceptar l&#8217;her\u00e8ncia pot fer la sol\u00b7licitud de forma telem\u00e0tica.   <\/p>\n<h3><strong>Valoraci\u00f3 immobili\u00e0ria o Taxaci\u00f3 a preu de mercat de les propietats<\/strong><\/h3>\n<p>En el testament hi sol haver un inventari dels b\u00e9ns que posse\u00efa el difunt. Des de la publicaci\u00f3 de la Llei 11\/2021 de 9 de juliol de mesures de prevenci\u00f3 i lluita contra el frau fiscal s&#8217;ha modificat la forma de tributar <strong>l&#8217;impost de successions<\/strong> pel que fa als immobles heretat. En la valoraci\u00f3 de l&#8217; inventari s&#8217; hauran de tenir en compte els <a href=\"https:\/\/www.sedecatastro.gob.es\/\">valors de refer\u00e8ncia publicats en cadastre<\/a>, i en cas que no existeixi valor, s&#8217; haur\u00e0 d&#8217; acudir a una <strong>taxaci\u00f3 a preu de mercat<\/strong> o valoraci\u00f3 la pot fer un expert immobiliari. Els d&#8217; enterrament i funeral hauran de guardar per descomptar-los de la base imposable de l&#8217; impost de successions. <\/p>\n<p>Tota aquesta documentaci\u00f3 s&#8217;haur\u00e0 de presentar a la notaria per poder procedir a l&#8217;acceptaci\u00f3 de l&#8217;her\u00e8ncia, que un cop registrada ens permetr\u00e0 vendre els immobles heretats. El notari li demanar\u00e0 que <strong>aporti una valoraci\u00f3 a preu de mercat dels immobles inventariats en el testament<\/strong>, <\/p>\n<p><strong> <\/strong><\/p>\n<p>Si la <strong>intenci\u00f3 final \u00e9s vendre l&#8217; immoble<\/strong>, li caldr\u00e0 una <strong>valoraci\u00f3 professional ajustada al preu de mercat<\/strong>. D&#8217; aquesta manera aconsegueix que els impostos que pagar\u00e0 per l&#8217; acceptaci\u00f3 de l&#8217; her\u00e8ncia i la pr\u00f2pia venda, siguin la menor quantitat possible. <\/p>\n<p>Vam explicar tot el proc\u00e9s <strong>de l&#8217;acceptaci\u00f3 de l&#8217;her\u00e8ncia<\/strong> amb vista a <strong>vendre les propietats <\/strong>que reben els hereus tant si el difunt va testar com si no.<\/p>\n<h2>Acceptaci\u00f3 de l&#8217; Her\u00e8ncia amb testament<\/h2>\n<p>El primer que l <strong>&#8216; hereu o hereus<\/strong> ha de fer \u00e9s acceptar l&#8217; her\u00e8ncia. Per aix\u00f2 hem de saber si hi ha o no testament. <\/p>\n<p>Quan la persona mor, els seus familiars han d&#8217;acudir a les autoritats amb el <strong>certificat de defunci\u00f3<\/strong> i sol\u00b7licitar les <strong>\u00faltimes voluntats<\/strong>. Aquest document permetr\u00e0 saber si el mort <strong>va fer testament<\/strong>, la data i on es troba dipositat per obtenir-ne una c\u00f2pia en cas que no se&#8217; n disposi. <\/p>\n<p>El <strong>Certificat d&#8217;\u00daltimes Voluntats<\/strong> es pot sol\u00b7licitar en qualsevol de les Ger\u00e8ncies Territorials del Ministeri de Just\u00edcia, en els Registres Civils de tota Espanya, en l&#8217;Oficina Central d&#8217;Atenci\u00f3 al Ciutad\u00e0 o qualsevol altre organisme oficial habilitat per a realitzar el tr\u00e0mit de la sol\u00b7licitud. Aquest certificat ens ha de servir <strong>per saber si el difunt havia atorgat testament o no<\/strong>, i en quina notaria i data es va atorgar l&#8217; escriptura. <\/p>\n<p>En pres\u00e8ncia d&#8217; un notari,<strong> l&#8217; hereu o hereus han de signar les escriptures d&#8217; adjudicaci\u00f3 i acceptaci\u00f3 de l&#8217; her\u00e8ncia<\/strong> en q\u00fcesti\u00f3.<\/p>\n<h2>Acceptaci\u00f3 de l&#8217;her\u00e8ncia sense testament \u2013 Ab intestat<\/h2>\n<p>En cas de no existir testament, els hereus leg\u00edtims; c\u00f2njuge, fills&#8230; Hauran d&#8217; acudir al <strong>notari que correspongui per ve\u00efnatge,<\/strong> amb el certificat de defunci\u00f3 i les darreres voluntats, per obrir un procediment de reclamaci\u00f3 d&#8217; her\u00e8ncia. Hauran d&#8217; acreditar el parentiu amb un certificat de naixement. Finalment, es requerir\u00e0 la pres\u00e8ncia d&#8217; almenys, dos testimonis que corroborin la veracitat dels fets que es declarin davant el notari. Un cop determinats els hereus es podr\u00e0 procedir a l&#8217; escriptura d&#8217; acceptaci\u00f3 de l&#8217; her\u00e8ncia.   <\/p>\n<p>&nbsp;<\/p>\n<h2>Valoraci\u00f3 de les propietats en cas d&#8217; her\u00e8ncia<\/h2>\n<p>Un punt rellevant en el moment d&#8217; acceptar l&#8217; her\u00e8ncia \u00e9s el <strong>preu d&#8217; adjudicaci\u00f3<\/strong> de les propietats. El valor es pot consultar a la p\u00e0gina <a href=\"https:\/\/www.sedecatastro.gob.es\/\">web de Cadastre<\/a>, Aquest valor \u00e9s calculat de forma autom\u00e0tica mitjan\u00e7ant un algoritme que t\u00e9 en compte les \u00faltimes vendes a la zona. \u00c9s una aproximaci\u00f3 i en ocasions pot ser bastant imprec\u00eds.   A m\u00e9s, per optimitzar el pagament d&#8217; impostos \u00e9s recomanable consultar amb un <a href=\"https:\/\/arqresidencial.com\/ca\/contacte\/\">professional immobiliari per verificar quin valor li conv\u00e9 declarar en l&#8217; acceptaci\u00f3 de l&#8217; her\u00e8ncia<\/a>.  <\/p>\n<p>Demano assessorament d&#8217;un dels experts d&#8217;Arquitectura Residencial sense comprom\u00eds.  <strong>Pot demanar una valoraci\u00f3 emplenant aquest formulari.  <\/strong><\/p>\n<h2>Impost de successions<\/h2>\n<p>A aquest primer pas li segueix la cancel\u00b7laci\u00f3 de<strong> l&#8217;Impost sobre Successions<\/strong>i <strong>Donacions<\/strong> abans del venciment d&#8217;un termini de <strong>6 mesos<\/strong> des de la data de defunci\u00f3. En pagar, l&#8217; hereu rebr\u00e0 un justificant de pagament que habilitar\u00e0 la<strong> inscripci\u00f3 de l&#8217; her\u00e8ncia<\/strong>. <\/p>\n<h2>L&#8217; impost de successions i donacions es pot ajornar o fraccionar<\/h2>\n<p>Pagar <strong>l&#8217;Impost sobre Successions i Donacions,<\/strong> com esment\u00e0vem abans, \u00e9s moltes vegades un impediment per a l&#8217;acceptaci\u00f3 de l&#8217;her\u00e8ncia: moltes persones es veuen for\u00e7ades a renunciar a les seves her\u00e8ncies perqu\u00e8 no compten amb el capital necessari per fer front a l&#8217;impost o perqu\u00e8 simplement moltes vegades calculant els impostos propis de l&#8217;acceptaci\u00f3 i les c\u00e0rregues dels immobles,  no \u00e9s rendible acceptar l&#8217; her\u00e8ncia.<\/p>\n<p>A causa d&#8217;aix\u00f2, hi ha la possibilitat de sol\u00b7licitar un ajornament que permeti pagar m\u00e9s tard, donant temps a l&#8217;hereu d&#8217;obtenir finan\u00e7ament o de vendre. Actualment, la llei permet sol\u00b7licitar a <strong>Hisenda un ajornament del pagament a 6 mesos, que al seu torn es pot prorrogar a un any i fins i tot fraccionar els pagaments durant 5 anys.<\/strong> Si l&#8217; hereu est\u00e0 interessat, l&#8217; ha de demanar abans que es compleixin 5 mesos del moment de la defunci\u00f3. <\/p>\n<p>En aquest punt, ja estaria cancel\u00b7lat el conegut impost de successions. Tanmateix, un segon impost ha de ser pagat en el cas de b\u00e9ns immobles per l&#8217; hereu per poder procedir a vendre la propietat. Es tracta d&#8217; un impost municipal, la <strong>Plusv\u00e0lua Municipal o IVTNU<\/strong>, grava l <strong>&#8216; increment de valors dels terrenys de naturalesa urbana<\/strong>, i fins a la data, es calcula tenint en compte el nombre d&#8217; anys transcorreguts des que el mort va adquirir la propietat fins a la data de defunci\u00f3. Aquest impost assoleix el seu <strong>valor m\u00e0xim als 20 anys<\/strong>, data en la qual ja no s&#8217; incrementar\u00e0. Al seu torn, en cas de venda, l&#8217; hereu torna a pagar aquest impost des de la data en qu\u00e8 ha heretat, fins a la data de venda.    <\/p>\n<p>Per aquest motiu, algunes ag\u00e8ncies immobili\u00e0ries recomanen la venda r\u00e0pida de l&#8217;immoble. Tanmateix, val la pena valorar si ens interessa mantenir-lo i obtenir unes rendes per ell. Actualment a Catalunya hi ha un m\u00e0xim de preu en el lloguer dels habitatges ubicats en zones tensionades.
